第一章 總則  

第一條 為了完善勞(lao)動合同(tong)制度,明(ming)確(que)勞(lao)動合同(tong)雙(shuang)方(fang)當事人的(de)權利和(he)義務,保護勞(lao)動者的(de)合法(fa)權益,構建和(he)發展和(he)諧穩定的(de)勞(lao)動關系,制定本法(fa)。  

第二條 中華(hua)人民共(gong)和(he)國境(jing)內(nei)的企業(ye)、個(ge)體(ti)經濟組(zu)織、民辦非企業(ye)單位等(deng)組(zu)織(以下(xia)稱用人單位)與(yu)勞動(dong)者建立(li)勞動(dong)關系(xi),訂立(li)、履行、變更(geng)、解除或者終(zhong)止(zhi)勞動(dong)合(he)同(tong),適用本法。  

國(guo)家(jia)機關(guan)、事業(ye)單位、社會團體(ti)和與其建(jian)立勞動(dong)關(guan)系的勞動(dong)者(zhe),訂立、履(lv)行、變更(geng)、解除或(huo)者(zhe)終止(zhi)勞動(dong)合同(tong),依照本法執行。  

第三條 訂立勞動合同,應當遵循合法、公平、平等自愿、協商一(yi)致、誠實信用的原(yuan)則(ze)。  

依法訂立的勞(lao)動(dong)(dong)合(he)同具有約(yue)束力(li),用人單位與勞(lao)動(dong)(dong)者(zhe)應當(dang)履行勞(lao)動(dong)(dong)合(he)同約(yue)定的義務。  

第四條 用人(ren)單(dan)位應當依法建立和完善勞動(dong)規(gui)章制度(du),保障勞動(dong)者(zhe)享有勞動(dong)權利、履(lv)行勞動(dong)義(yi)務。  

用人單位在制定(ding)、修改或(huo)者(zhe)(zhe)決定(ding)有關勞動(dong)報(bao)酬、工作時(shi)間、休息休假、勞動(dong)安全(quan)衛生(sheng)、保(bao)險福(fu)利(li)、職(zhi)工培訓、勞動(dong)紀律(lv)以及(ji)(ji)勞動(dong)定(ding)額管理等(deng)直接涉及(ji)(ji)勞動(dong)者(zhe)(zhe)切身利(li)益的(de)規章制度或(huo)者(zhe)(zhe)重大(da)事項時(shi),應當經職(zhi)工代表大(da)會(hui)或(huo)者(zhe)(zhe)全(quan)體職(zhi)工討論,提出方案和(he)意(yi)見,與工會(hui)或(huo)者(zhe)(zhe)職(zhi)工代表平(ping)等(deng)協商確(que)定(ding)。  

在規章制度和(he)重大(da)事項決定實施過程中,工會或(huo)者職工認為不(bu)適當的,有權(quan)向用人單位提(ti)出,通過協商予以修改完善(shan)。  

用人單位應當將直接涉及勞(lao)(lao)動(dong)者(zhe)切身利益的規章(zhang)制度(du)和重大事項決(jue)定公示,或者(zhe)告知勞(lao)(lao)動(dong)者(zhe)。  

第五條 縣級以上人民政府(fu)勞動(dong)行(xing)政部門會同(tong)工會和企業方(fang)面(mian)代表(biao),建(jian)立健全協調勞動(dong)關系三方(fang)機制,共同(tong)研(yan)究解決有(you)關勞動(dong)關系的重大問(wen)題(ti)。  

第六(liu)條 工會應當幫(bang)助、指導勞動(dong)者與用人單(dan)位依法(fa)訂立(li)和(he)履行勞動(dong)合同,并(bing)與用人單(dan)位建立(li)集體協商機(ji)制,維(wei)護勞動(dong)者的合法(fa)權(quan)益。  

第二章 勞動合同的訂立  

第七條 用人單位(wei)自用工(gong)之(zhi)日起即與(yu)勞動者建(jian)立(li)(li)勞動關(guan)系。用人單位(wei)應(ying)當建(jian)立(li)(li)職(zhi)工(gong)名冊備查。  

第八條 用(yong)人單(dan)位招用(yong)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)時,應當如實(shi)告知勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)工作內容、工作條件、工作地點、職業危害、安全(quan)生產狀況(kuang)、勞(lao)(lao)(lao)動(dong)(dong)(dong)報酬,以及勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)要(yao)求了解的其他(ta)情(qing)況(kuang);用(yong)人單(dan)位有(you)權了解勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)與勞(lao)(lao)(lao)動(dong)(dong)(dong)合同直接相關的基本情(qing)況(kuang),勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)應當如實(shi)說明。  

第九(jiu)條 用(yong)人單位招用(yong)勞(lao)(lao)動(dong)者,不(bu)得扣押勞(lao)(lao)動(dong)者的居民身份證和(he)其他(ta)證件,不(bu)得要求(qiu)勞(lao)(lao)動(dong)者提(ti)供擔(dan)保或者以其他(ta)名義(yi)向勞(lao)(lao)動(dong)者收取財物。  

第十條 建立勞動關(guan)系,應(ying)當訂立書面勞動合同。  

已(yi)建立(li)勞(lao)動(dong)關系,未同時訂立(li)書面勞(lao)動(dong)合(he)同的,應當(dang)自用工之日(ri)起一個(ge)月內訂立(li)書面勞(lao)動(dong)合(he)同。  

用(yong)人(ren)單(dan)位(wei)與勞(lao)動(dong)者在(zai)用(yong)工前訂立(li)(li)勞(lao)動(dong)合同(tong)的,勞(lao)動(dong)關系自用(yong)工之日起建立(li)(li)。  

第十一條 用(yong)人(ren)單位未在用(yong)工的(de)同(tong)(tong)時訂立書面勞(lao)動(dong)合同(tong)(tong),與勞(lao)動(dong)者約定的(de)勞(lao)動(dong)報酬不明確的(de),新招用(yong)的(de)勞(lao)動(dong)者的(de)勞(lao)動(dong)報酬按照集(ji)(ji)體(ti)合同(tong)(tong)規定的(de)標準執行;沒有集(ji)(ji)體(ti)合同(tong)(tong)或者集(ji)(ji)體(ti)合同(tong)(tong)未規定的(de),實行同(tong)(tong)工同(tong)(tong)酬。  

第(di)十二條(tiao) 勞(lao)(lao)動合(he)同分(fen)為固(gu)(gu)定期(qi)限(xian)勞(lao)(lao)動合(he)同、無固(gu)(gu)定期(qi)限(xian)勞(lao)(lao)動合(he)同和以完成一(yi)定工作任(ren)務為期(qi)限(xian)的(de)勞(lao)(lao)動合(he)同。  

第十三條 固(gu)定期限勞(lao)動(dong)(dong)合同(tong),是(shi)指用(yong)人單位與勞(lao)動(dong)(dong)者約(yue)定合同(tong)終(zhong)止時間(jian)的勞(lao)動(dong)(dong)合同(tong)。  

用人單位與勞動者協商(shang)一致,可以訂立(li)固定(ding)期限勞動合同(tong)。  

第十四條 無固(gu)定(ding)期限勞(lao)動合(he)(he)同(tong),是指(zhi)用人單位(wei)與勞(lao)動者(zhe)約定(ding)無確定(ding)終止時間(jian)的(de)勞(lao)動合(he)(he)同(tong)。  

用人單位與(yu)勞(lao)動(dong)(dong)者(zhe)協商(shang)一致(zhi),可以訂(ding)立(li)(li)(li)無(wu)固(gu)定期限(xian)勞(lao)動(dong)(dong)合(he)同(tong)(tong)。有(you)下列情形(xing)之一,勞(lao)動(dong)(dong)者(zhe)提出或者(zhe)同(tong)(tong)意續訂(ding)、訂(ding)立(li)(li)(li)勞(lao)動(dong)(dong)合(he)同(tong)(tong)的,除勞(lao)動(dong)(dong)者(zhe)提出訂(ding)立(li)(li)(li)固(gu)定期限(xian)勞(lao)動(dong)(dong)合(he)同(tong)(tong)外(wai),應當訂(ding)立(li)(li)(li)無(wu)固(gu)定期限(xian)勞(lao)動(dong)(dong)合(he)同(tong)(tong):  

(一(yi))勞動者在(zai)該用人單(dan)位連續(xu)工(gong)作滿十年的;  

(二(er))用(yong)人單(dan)位(wei)初次實行勞動(dong)合同制(zhi)(zhi)度或者國(guo)有企業(ye)改制(zhi)(zhi)重新訂立勞動(dong)合同時,勞動(dong)者在該用(yong)人單(dan)位(wei)連續(xu)工(gong)作滿十年且距法定退(tui)休(xiu)年齡不(bu)足十年的;  

(三)連續(xu)訂立二次固(gu)定(ding)期限(xian)勞動合同,且勞動者沒有本法第(di)三十(shi)九條和第(di)四十(shi)條第(di)一項、第(di)二項規定(ding)的(de)(de)情形,續(xu)訂勞動合同的(de)(de)。  

用(yong)人(ren)單位(wei)自用(yong)工之日起(qi)滿(man)一年不與勞(lao)動(dong)者訂(ding)(ding)立書(shu)面(mian)勞(lao)動(dong)合(he)同的,視為(wei)用(yong)人(ren)單位(wei)與勞(lao)動(dong)者已訂(ding)(ding)立無固定期(qi)限勞(lao)動(dong)合(he)同。  

第十五(wu)條 以完成(cheng)一定工(gong)作任務為期限的勞(lao)動合(he)同(tong)(tong),是指用(yong)人(ren)單位與勞(lao)動者約定以某項工(gong)作的完成(cheng)為合(he)同(tong)(tong)期限的勞(lao)動合(he)同(tong)(tong)。  

用人單位與(yu)勞動者協(xie)商(shang)一致,可以(yi)訂立以(yi)完成一定工(gong)作任務為(wei)期限的勞動合同。  

第(di)十六條 勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)由(you)用人單(dan)位(wei)與(yu)勞(lao)(lao)動(dong)(dong)者(zhe)協商一致,并經用人單(dan)位(wei)與(yu)勞(lao)(lao)動(dong)(dong)者(zhe)在勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)文(wen)本上簽(qian)字或者(zhe)蓋章生(sheng)效。  

勞動合(he)同文本由(you)用人單位和勞動者(zhe)各執(zhi)一份。  

第十七條 勞動合同應當具備以下條款:  

(一)用人(ren)單位的(de)名(ming)稱、住所和法定代表(biao)人(ren)或者主要(yao)負責人(ren);  

(二)勞動者(zhe)的姓名、住址和(he)居(ju)民身份證或者(zhe)其他有效身份證件號碼;  

(三)勞動合同期(qi)限;  

(四)工作內容(rong)和(he)工作地(di)點;  

(五)工(gong)作時間和休(xiu)(xiu)息休(xiu)(xiu)假;  

(六)勞動報酬;  

(七)社(she)會(hui)保險;  

八)勞(lao)動保護(hu)、勞(lao)動條件和(he)職業危害防護(hu);  

(九)法律(lv)、法規規定應當(dang)納入(ru)勞(lao)動(dong)合同(tong)的其他事項。  

勞動(dong)合同除前款規定(ding)的必備條款外,用(yong)人單位與勞動(dong)者可以約定(ding)試用(yong)期、培(pei)訓、保(bao)守(shou)秘密、補充保(bao)險和福利(li)待遇等其他事項。  

第十八條 勞(lao)動(dong)合同(tong)(tong)(tong)對勞(lao)動(dong)報酬和勞(lao)動(dong)條件等標(biao)準(zhun)約(yue)定(ding)(ding)(ding)不明確(que),引發爭議的,用人(ren)單位(wei)與勞(lao)動(dong)者可以重(zhong)新協(xie)商(shang);協(xie)商(shang)不成的,適(shi)用集(ji)體合同(tong)(tong)(tong)規(gui)定(ding)(ding)(ding);沒(mei)有(you)集(ji)體合同(tong)(tong)(tong)或者集(ji)體合同(tong)(tong)(tong)未規(gui)定(ding)(ding)(ding)勞(lao)動(dong)報酬的,實行同(tong)(tong)(tong)工同(tong)(tong)(tong)酬;沒(mei)有(you)集(ji)體合同(tong)(tong)(tong)或者集(ji)體合同(tong)(tong)(tong)未規(gui)定(ding)(ding)(ding)勞(lao)動(dong)條件等標(biao)準(zhun)的,適(shi)用國家有(you)關規(gui)定(ding)(ding)(ding)。  

第(di)十九條 勞(lao)動(dong)合同期(qi)限三個(ge)月以上不(bu)(bu)滿一年(nian)的(de),試(shi)用(yong)期(qi)不(bu)(bu)得超(chao)過(guo)一個(ge)月;勞(lao)動(dong)合同期(qi)限一年(nian)以上不(bu)(bu)滿三年(nian)的(de),試(shi)用(yong)期(qi)不(bu)(bu)得超(chao)過(guo)二(er)個(ge)月;三年(nian)以上固(gu)定(ding)期(qi)限和無固(gu)定(ding)期(qi)限的(de)勞(lao)動(dong)合同,試(shi)用(yong)期(qi)不(bu)(bu)得超(chao)過(guo)六(liu)個(ge)月。  

同(tong)一(yi)用(yong)人單位與(yu)同(tong)一(yi)勞動者(zhe)只能約定一(yi)次(ci)試用(yong)期。  

以(yi)完成一定(ding)工作任務為(wei)期(qi)限的勞(lao)動合同(tong)或(huo)者勞(lao)動合同(tong)期(qi)限不滿(man)三個(ge)月的,不得約(yue)定(ding)試用期(qi)。  

試用(yong)(yong)期(qi)(qi)包含(han)在(zai)勞動合同(tong)期(qi)(qi)限(xian)內。勞動合同(tong)僅約(yue)定試用(yong)(yong)期(qi)(qi)的(de),試用(yong)(yong)期(qi)(qi)不成(cheng)立(li),該期(qi)(qi)限(xian)為(wei)勞動合同(tong)期(qi)(qi)限(xian)。  

第(di)二十條 勞(lao)動(dong)者在(zai)(zai)試用期的(de)工資(zi)不(bu)得(de)低(di)(di)于(yu)本單位(wei)(wei)相同崗位(wei)(wei)最低(di)(di)檔工資(zi)或者勞(lao)動(dong)合同約定工資(zi)的(de)百(bai)分之八十,并不(bu)得(de)低(di)(di)于(yu)用人(ren)單位(wei)(wei)所在(zai)(zai)地的(de)最低(di)(di)工資(zi)標準。  

第(di)二十一條(tiao) 在試用期(qi)中,除(chu)勞動(dong)(dong)者有(you)本法第(di)三十九條(tiao)和第(di)四十條(tiao)第(di)一項、第(di)二項規定的情形(xing)外,用人單位(wei)不得(de)解(jie)除(chu)勞動(dong)(dong)合同。用人單位(wei)在試用期(qi)解(jie)除(chu)勞動(dong)(dong)合同的,應當向勞動(dong)(dong)者說明(ming)理由。  

第二十二條 用人單位為勞動(dong)者(zhe)提供專項培(pei)訓費用,對其進行專業(ye)技術培(pei)訓的,可以(yi)與(yu)該勞動(dong)者(zhe)訂立協議(yi),約定服務期。  

勞動者違(wei)反服務期約定(ding)(ding)的(de),應當(dang)按照(zhao)約定(ding)(ding)向用(yong)人單(dan)位(wei)支付違(wei)約金(jin)(jin)。違(wei)約金(jin)(jin)的(de)數額不得超(chao)過(guo)用(yong)人單(dan)位(wei)提供的(de)培(pei)訓(xun)費(fei)用(yong)。用(yong)人單(dan)位(wei)要求勞動者支付的(de)違(wei)約金(jin)(jin)不得超(chao)過(guo)服務期尚(shang)未履行部分(fen)所應分(fen)攤的(de)培(pei)訓(xun)費(fei)用(yong)。  

用人單位與勞(lao)動者(zhe)約定服務(wu)期(qi)(qi)的(de),不(bu)影(ying)響(xiang)按(an)照正常的(de)工資調整(zheng)機制提高勞(lao)動者(zhe)在服務(wu)期(qi)(qi)期(qi)(qi)間的(de)勞(lao)動報(bao)酬。  

第(di)二十三條(tiao) 用人單(dan)位(wei)與勞動(dong)者可以在勞動(dong)合同(tong)中約(yue)定(ding)保守用人單(dan)位(wei)的商業秘密(mi)和(he)與知識(shi)產權相關的保密(mi)事項。  

對(dui)負有保密義務(wu)的勞(lao)動(dong)者(zhe)(zhe),用人(ren)單(dan)位(wei)可(ke)以在勞(lao)動(dong)合同(tong)或(huo)者(zhe)(zhe)保密協議中與勞(lao)動(dong)者(zhe)(zhe)約(yue)定競業限(xian)(xian)制(zhi)條(tiao)款,并(bing)約(yue)定在解(jie)除或(huo)者(zhe)(zhe)終止勞(lao)動(dong)合同(tong)后,在競業限(xian)(xian)制(zhi)期限(xian)(xian)內按月給予勞(lao)動(dong)者(zhe)(zhe)經濟補償(chang)。勞(lao)動(dong)者(zhe)(zhe)違(wei)(wei)反競業限(xian)(xian)制(zhi)約(yue)定的,應當按照約(yue)定向用人(ren)單(dan)位(wei)支付(fu)違(wei)(wei)約(yue)金(jin)。  

第(di)二十四條 競(jing)業限(xian)制(zhi)的(de)(de)人(ren)員(yuan)限(xian)于用(yong)人(ren)單位的(de)(de)高級管理人(ren)員(yuan)、高級技術人(ren)員(yuan)和(he)其他負有保密義務的(de)(de)人(ren)員(yuan)。競(jing)業限(xian)制(zhi)的(de)(de)范圍、地域(yu)、期限(xian)由用(yong)人(ren)單位與勞動者約(yue)定,競(jing)業限(xian)制(zhi)的(de)(de)約(yue)定不得違反法律、法規(gui)的(de)(de)規(gui)定。  

在解除或者(zhe)(zhe)(zhe)終止勞(lao)動合同(tong)(tong)后,前(qian)款(kuan)規定的人(ren)員到(dao)與本單(dan)位生產(chan)(chan)或者(zhe)(zhe)(zhe)經營同(tong)(tong)類產(chan)(chan)品、從事(shi)同(tong)(tong)類業務的有競爭關系(xi)的其他用人(ren)單(dan)位,或者(zhe)(zhe)(zhe)自(zi)己開業生產(chan)(chan)或者(zhe)(zhe)(zhe)經營同(tong)(tong)類產(chan)(chan)品、從事(shi)同(tong)(tong)類業務的競業限制期限,不得超過(guo)二年。  

第二(er)(er)十五條 除本(ben)法第二(er)(er)十二(er)(er)條和第二(er)(er)十三條規定的情形外,用人(ren)單位不得與勞動(dong)(dong)者(zhe)約(yue)定由勞動(dong)(dong)者(zhe)承擔違約(yue)金。  

第二十六條 下(xia)列勞動合(he)同(tong)無效(xiao)或者部分無效(xiao):  

(一)以欺(qi)詐、脅迫(po)的(de)手(shou)段或者乘人之(zhi)危,使對方(fang)在(zai)違背真實意思的(de)情況下訂立或者變(bian)更勞動合同的(de);  

(二)用(yong)人單位免除(chu)自己的法定責任、排除(chu)勞動者權利(li)的;  

(三)違反(fan)法(fa)(fa)律、行政法(fa)(fa)規(gui)強(qiang)制性規(gui)定的。  

對(dui)勞動合同的(de)無(wu)效或者部分無(wu)效有爭議的(de),由(you)勞動爭議仲裁機構(gou)或者人民法院確認。  

第(di)二十七條 勞動合同部(bu)分(fen)無效,不影響其他部(bu)分(fen)效力的,其他部(bu)分(fen)仍然有(you)效。  

第二(er)十八條(tiao) 勞(lao)(lao)(lao)動(dong)合同被確(que)(que)認無效,勞(lao)(lao)(lao)動(dong)者已付(fu)出(chu)勞(lao)(lao)(lao)動(dong)的,用(yong)人單位(wei)應當向勞(lao)(lao)(lao)動(dong)者支付(fu)勞(lao)(lao)(lao)動(dong)報(bao)(bao)酬。勞(lao)(lao)(lao)動(dong)報(bao)(bao)酬的數額,參照本單位(wei)相同或(huo)者相近崗位(wei)勞(lao)(lao)(lao)動(dong)者的勞(lao)(lao)(lao)動(dong)報(bao)(bao)酬確(que)(que)定。  

第三章 勞(lao)動(dong)合同(tong)(tong)的(de)履行和變(bian)更(geng)  第二十(shi)九條 用人單位與勞(lao)動(dong)者應當按照勞(lao)動(dong)合同(tong)(tong)的(de)約定,全(quan)面履行各自的(de)義務(wu)。  

第三十條 用人單位應當按照勞(lao)動(dong)合同約定和國家規(gui)定,向勞(lao)動(dong)者及(ji)時足額支付勞(lao)動(dong)報酬。  

用人單位拖欠或(huo)者(zhe)未(wei)足(zu)額(e)支付(fu)勞動(dong)報酬的,勞動(dong)者(zhe)可以依(yi)法向當(dang)地人民法院申請支付(fu)令(ling),人民法院應當(dang)依(yi)法發(fa)出(chu)支付(fu)令(ling)。  

第三十一條 用(yong)(yong)人(ren)單位應(ying)當嚴格(ge)執行勞動定(ding)(ding)額標準,不(bu)得(de)強迫或者變相強迫勞動者加班。用(yong)(yong)人(ren)單位安排(pai)加班的,應(ying)當按照國家有(you)關規定(ding)(ding)向勞動者支付加班費(fei)。  

第三十二條 勞(lao)動者拒絕(jue)用人單位管理人員違章(zhang)指揮、強(qiang)令(ling)冒險(xian)作業的(de),不視為違反勞(lao)動合同。  

勞動者(zhe)對(dui)危害生命安全和身體健(jian)康的勞動條(tiao)件,有權對(dui)用人(ren)單位提出批評、檢舉和控告。  

第(di)三十(shi)三條 用人單位變更名稱、法定代表人、主要負責人或(huo)者投資人等(deng)事項,不(bu)影(ying)響勞(lao)動合同的履行。  

第三十四(si)條 用人單位(wei)發生合(he)并或者分立等情況,原(yuan)勞(lao)(lao)動合(he)同繼續有效,勞(lao)(lao)動合(he)同由承(cheng)繼其(qi)權利(li)和義務的用人單位(wei)繼續履行。  

第三十(shi)五條 用人單位與勞動(dong)者(zhe)協商一致,可以(yi)變更(geng)勞動(dong)合同(tong)約定的內容。變更(geng)勞動(dong)合同(tong),應當采用書面(mian)形式。  

變更后的勞動合同文本由用人單位和勞動者各執(zhi)一份。  

第四(si)章-勞動(dong)合(he)同的解除和終止  

第三十六條(tiao) 用人單位與勞動(dong)者協(xie)商(shang)一致,可以解(jie)除勞動(dong)合同(tong)。  

第三十(shi)七條 勞(lao)動者提(ti)前(qian)(qian)三十(shi)日以(yi)書面形(xing)式通知(zhi)用人單位(wei),可以(yi)解除勞(lao)動合同。勞(lao)動者在(zai)試用期內提(ti)前(qian)(qian)三日通知(zhi)用人單位(wei),可以(yi)解除勞(lao)動合同。  

第三十八條(tiao) 用人單位(wei)有(you)下列情(qing)形之(zhi)一的,勞動者可以解除(chu)勞動合同:  

(一)未按(an)照勞(lao)動合(he)同約定提供勞(lao)動保護(hu)或者勞(lao)動條件的;  

(二)未及時足額(e)支付勞動報(bao)酬的;  

(三)未(wei)依法為勞動者繳納社會保險費的;  

(四)用人單位的(de)規章制度違反法(fa)(fa)律、法(fa)(fa)規的(de)規定,損害勞動者(zhe)權益的(de);  

(五(wu))因(yin)本(ben)法第(di)二十六條第(di)一款規定(ding)的情形(xing)致使勞動合同無(wu)效(xiao)的;  

(六)法(fa)律、行政法(fa)規規定勞動者(zhe)可(ke)以解(jie)除勞動合同的其(qi)他情(qing)形。  

用(yong)人(ren)單(dan)(dan)位(wei)以暴力、威(wei)脅或(huo)者(zhe)(zhe)非法(fa)限制人(ren)身(shen)自由的手段強迫勞動者(zhe)(zhe)勞動的,或(huo)者(zhe)(zhe)用(yong)人(ren)單(dan)(dan)位(wei)違章指(zhi)揮、強令冒險作業(ye)危及勞動者(zhe)(zhe)人(ren)身(shen)安全的,勞動者(zhe)(zhe)可以立即解除勞動合同,不(bu)需(xu)事先告知用(yong)人(ren)單(dan)(dan)位(wei)。  

第三十九條 勞動者有下(xia)列情形之一的,用(yong)人(ren)單位可以解除勞動合同(tong):  

(一)在(zai)試用期間被證明不符合錄用條件的;  

(二)嚴重違反用(yong)人單(dan)位的(de)規章制度的(de);  

(三)嚴重失職,營私舞弊(bi),給(gei)用人單位造(zao)成重大(da)損害(hai)的(de);  

四)勞動者同時與其他用(yong)(yong)人(ren)單(dan)位(wei)(wei)建立勞動關系(xi),對完成本單(dan)位(wei)(wei)的工作任務造成嚴(yan)重影響,或者經(jing)用(yong)(yong)人(ren)單(dan)位(wei)(wei)提(ti)出,拒不改正的;  

(五)因(yin)本法第二十六條第一(yi)款第一(yi)項規定的情形致使(shi)勞動(dong)合同無效的;  

(六)被依法追究刑(xing)事責任的。  

第四十條 有下(xia)列(lie)情(qing)形之一的,用人單位提前三(san)十日(ri)以(yi)書面形式通知勞(lao)(lao)動者本人或者額(e)外支(zhi)付勞(lao)(lao)動者一個月工資后(hou),可以(yi)解除勞(lao)(lao)動合同(tong):  

(一(yi))勞動(dong)者(zhe)患病或(huo)者(zhe)非因工(gong)負傷,在規定的醫療期滿后不(bu)能從事原工(gong)作,也不(bu)能從事由(you)用人單位另行安排的工(gong)作的;  

(二)勞動者不能勝任(ren)工(gong)作(zuo),經過培訓或者調整(zheng)工(gong)作(zuo)崗(gang)位,仍不能勝任(ren)工(gong)作(zuo)的;  

(三)勞(lao)動合同(tong)訂立(li)時所依據(ju)的客觀(guan)情況發(fa)生重大(da)變化,致(zhi)使(shi)勞(lao)動合同(tong)無法(fa)履行,經(jing)用人單位與勞(lao)動者協(xie)商(shang),未能就變更勞(lao)動合同(tong)內容達成協(xie)議的。  

第四十一(yi)條 有下列情形之(zhi)(zhi)一(yi),需要裁(cai)減人員二十人以(yi)上或(huo)者裁(cai)減不足二十人但占企業職工總數百分之(zhi)(zhi)十以(yi)上的,用人單位(wei)提前三(san)十日向工會或(huo)者全體職工說明情況,聽(ting)取工會或(huo)者職工的意見后,裁(cai)減人員方(fang)案經(jing)向勞動行(xing)政(zheng)部門報告,可以(yi)裁(cai)減人員:  

(一(yi))依照企業破產法規定進行重整的;  

(二)生(sheng)產經營(ying)發生(sheng)嚴重困難的;  

(三)企業(ye)轉產(chan)、重大(da)技術革新或者經(jing)(jing)營方式調整,經(jing)(jing)變更(geng)勞(lao)動合同后,仍(reng)需裁減人員的;  

(四)其他(ta)因勞動(dong)合同(tong)訂立時所依據(ju)的客觀經濟(ji)情況(kuang)發(fa)生重大變化(hua),致使勞動(dong)合同(tong)無法履(lv)行(xing)的。  

裁減人(ren)員時,應當優先留用下(xia)列人(ren)員:  

(一)與本單位訂立較長(chang)期限的固定期限勞動合同的;  

(二)與本單位訂立無固定期限(xian)勞動(dong)合(he)同的;  

(三)家庭(ting)無其(qi)他就業人(ren)員,有需要撫養(yang)的老(lao)人(ren)或(huo)者未成年(nian)人(ren)的。  

用人(ren)(ren)(ren)單(dan)位依照本條第一款(kuan)規定裁(cai)減(jian)人(ren)(ren)(ren)員,在六個月內重(zhong)新招用人(ren)(ren)(ren)員的,應(ying)當(dang)通知被裁(cai)減(jian)的人(ren)(ren)(ren)員,并在同等條件(jian)下優先(xian)招用被裁(cai)減(jian)的人(ren)(ren)(ren)員。  

第四十二條(tiao)(tiao) 勞動者有下列情形之一的(de),用人單(dan)位不(bu)得(de)依照本法第四十條(tiao)(tiao)、第四十一條(tiao)(tiao)的(de)規定(ding)解除勞動合同:  

(一(yi))從事接(jie)觸職業(ye)(ye)病(bing)危害(hai)作業(ye)(ye)的(de)勞動者未(wei)進行離崗前(qian)職業(ye)(ye)健(jian)康檢查,或者疑似職業(ye)(ye)病(bing)病(bing)人(ren)在診斷(duan)或者醫學觀(guan)察(cha)期間(jian)的(de);  

(二)在本單位患職(zhi)業病(bing)或(huo)者因工負傷(shang)并(bing)被(bei)確認(ren)喪(sang)失或(huo)者部分喪(sang)失勞(lao)動能力(li)的;  

(三)患病或者非(fei)因工(gong)負傷,在(zai)規定的醫療期內的;  

(四)女職(zhi)工在孕期(qi)、產期(qi)、哺乳期(qi)的;  

(五)在本單位(wei)連(lian)續工作滿十五年(nian),且距(ju)法定退(tui)休年(nian)齡不足五年(nian)的;  

(六(liu))法(fa)律、行政法(fa)規規定的其他情形。  

第四十三條 用(yong)(yong)人單(dan)位單(dan)方解除勞動合同(tong),應(ying)當事先(xian)將理由(you)通(tong)知工會(hui)(hui)。用(yong)(yong)人單(dan)位違反法(fa)律(lv)、行政法(fa)規規定或者勞動合同(tong)約定的,工會(hui)(hui)有權要求用(yong)(yong)人單(dan)位糾正(zheng)。用(yong)(yong)人單(dan)位應(ying)當研究工會(hui)(hui)的意見(jian),并將處理結(jie)果(guo)書面通(tong)知工會(hui)(hui)。  

第四十四條 有下列情形之一的,勞動(dong)合(he)同終止:  

(一)勞動合同期滿(man)的(de);  

(二)勞動者開始依法享受基本養老保險(xian)待遇的;  

(三)勞動(dong)者死亡,或者被人民法院宣(xuan)告死亡或者宣(xuan)告失蹤(zong)的;  

(四)用人單位(wei)被(bei)依法宣告破產的(de);  

(五)用人單位(wei)被吊銷營業(ye)執照、責(ze)令關閉、撤(che)銷或者用人單位(wei)決定提前解散的;  

(六(liu))法律(lv)、行(xing)政(zheng)法規規定的其他情形。  

第(di)(di)四十五條 勞動(dong)合(he)(he)同(tong)期滿,有本(ben)法第(di)(di)四十二(er)條規定情形之一的(de),勞動(dong)合(he)(he)同(tong)應當續(xu)延至相應的(de)情形消失時終止。但是,本(ben)法第(di)(di)四十二(er)條第(di)(di)二(er)項規定喪(sang)失或者(zhe)部分喪(sang)失勞動(dong)能力勞動(dong)者(zhe)的(de)勞動(dong)合(he)(he)同(tong)的(de)終止,按照國家有關工傷保險的(de)規定執(zhi)行。  

第(di)四(si)十六(liu)條 有下(xia)列(lie)情(qing)形之一的,用(yong)人單位應(ying)當向勞動者支付(fu)經濟補償:  

(一)勞(lao)動者依照本(ben)法(fa)第三十八條規(gui)定解(jie)除勞(lao)動合(he)同的;  

(二)用(yong)人單位依照本法第三十六條規(gui)定(ding)向勞(lao)動(dong)者提出(chu)解(jie)除勞(lao)動(dong)合(he)(he)同并與勞(lao)動(dong)者協(xie)商一(yi)致(zhi)解(jie)除勞(lao)動(dong)合(he)(he)同的(de);  

(三(san))用(yong)人單位(wei)依照本法第(di)四(si)十(shi)條規定解除勞動合同的;  

(四)用人單(dan)位(wei)依照本法第四十(shi)一條第一款規(gui)定解除勞(lao)動(dong)合同的;  

(五)除用(yong)人(ren)單位維持或者提高(gao)勞(lao)動(dong)合同約(yue)定(ding)條件續(xu)訂勞(lao)動(dong)合同,勞(lao)動(dong)者不(bu)同意續(xu)訂的情形(xing)外,依照(zhao)本法第四十四條第一項(xiang)規定(ding)終止固定(ding)期限勞(lao)動(dong)合同的;  

(六)依照本法第(di)四十四條第(di)四項、第(di)五項規定終止勞動(dong)合同的;  

(七)法律、行政法規(gui)規(gui)定的(de)其他(ta)情(qing)形。  

第四(si)十(shi)七條 經(jing)濟(ji)補(bu)償(chang)按(an)勞(lao)動者在本單位工(gong)(gong)作的(de)年限(xian),每(mei)滿(man)一(yi)(yi)年支(zhi)付一(yi)(yi)個月(yue)工(gong)(gong)資的(de)標準向(xiang)勞(lao)動者支(zhi)付。六(liu)個月(yue)以(yi)上不(bu)滿(man)一(yi)(yi)年的(de),按(an)一(yi)(yi)年計(ji)算(suan);不(bu)滿(man)六(liu)個月(yue)的(de),向(xiang)勞(lao)動者支(zhi)付半個月(yue)工(gong)(gong)資的(de)經(jing)濟(ji)補(bu)償(chang)。  

勞動者月(yue)(yue)工(gong)資高(gao)于用人單位所在直(zhi)轄市、設區(qu)的市級(ji)人民政(zheng)府公(gong)布的本地區(qu)上年度(du)職工(gong)月(yue)(yue)平均工(gong)資三倍的,向其支付(fu)經(jing)濟補(bu)償的標準按職工(gong)月(yue)(yue)平均工(gong)資三倍的數額支付(fu),向其支付(fu)經(jing)濟補(bu)償的年限最高(gao)不超(chao)過十(shi)二年。  

本(ben)條所稱月工資是指勞(lao)動(dong)者(zhe)(zhe)在勞(lao)動(dong)合同解除或者(zhe)(zhe)終(zhong)止前(qian)十二個月的(de)平均工資。  

第四十(shi)八條(tiao) 用(yong)(yong)人(ren)單位違反本法(fa)規定解除(chu)或者(zhe)終止勞(lao)(lao)動(dong)(dong)合(he)同,勞(lao)(lao)動(dong)(dong)者(zhe)要(yao)求繼續(xu)履(lv)行勞(lao)(lao)動(dong)(dong)合(he)同的,用(yong)(yong)人(ren)單位應當繼續(xu)履(lv)行;勞(lao)(lao)動(dong)(dong)者(zhe)不(bu)要(yao)求繼續(xu)履(lv)行勞(lao)(lao)動(dong)(dong)合(he)同或者(zhe)勞(lao)(lao)動(dong)(dong)合(he)同已經不(bu)能繼續(xu)履(lv)行的,用(yong)(yong)人(ren)單位應當依照本法(fa)第八十(shi)七條(tiao)規定支(zhi)付賠(pei)償金。  

第四十九條 國家采取措施,建(jian)立(li)健全(quan)勞動者社會保險(xian)關系(xi)跨地區轉移接(jie)續制度。  

第五十條(tiao) 用人(ren)單位應當在(zai)解除或者終止勞動(dong)合同(tong)(tong)時出具解除或者終止勞動(dong)合同(tong)(tong)的證明,并在(zai)十五日內為勞動(dong)者辦理檔(dang)案(an)和社會保險關系轉移手續。  

勞動(dong)者(zhe)應當(dang)按照雙方約定(ding),辦(ban)理工作(zuo)交接。用人單位依照本法有關(guan)規定(ding)應當(dang)向勞動(dong)者(zhe)支付(fu)經(jing)濟補(bu)償(chang)的,在辦(ban)結工作(zuo)交接時支付(fu)。  

用人單位對已經解(jie)除或者終止的勞動合同(tong)的文本,至少保(bao)存(cun)二年備(bei)查。  

第五(wu)章 特別(bie)規定  

第一(yi)節 集體合同  

第五十一(yi)條 企業(ye)職(zhi)工一(yi)方與用人單位通(tong)過平等協商,可(ke)以(yi)就勞動報酬、工作時間(jian)、休息休假、勞動安全衛生、保險福利等事項訂立(li)集體(ti)合同(tong)。集體(ti)合同(tong)草案應當提(ti)交職(zhi)工代表大會或者全體(ti)職(zhi)工討論通(tong)過。  

集體合同由工(gong)會(hui)代表企業職工(gong)一方(fang)與用人(ren)單(dan)位訂立;尚(shang)未建(jian)立工(gong)會(hui)的(de)用人(ren)單(dan)位,由上(shang)級工(gong)會(hui)指導勞動者推舉的(de)代表與用人(ren)單(dan)位訂立。  

第五十二條(tiao) 企業職工(gong)一方(fang)與用人單(dan)位(wei)可(ke)以訂(ding)立(li)勞動安全衛(wei)生、女(nv)職工(gong)權益保護、工(gong)資調整機制等(deng)專項(xiang)集體合(he)同。  

第(di)五(wu)十三(san)條 在縣級以下區域內,建筑業(ye)、采礦(kuang)業(ye)、餐飲服(fu)務業(ye)等(deng)行(xing)業(ye)可(ke)以由工會(hui)與企(qi)業(ye)方面代表(biao)訂立行(xing)業(ye)性集(ji)體(ti)合同,或者訂立區域性集(ji)體(ti)合同。  

第五十四條(tiao) 集(ji)體(ti)合同訂立后,應當(dang)報送勞(lao)動行(xing)政部(bu)門;勞(lao)動行(xing)政部(bu)門自(zi)收到(dao)集(ji)體(ti)合同文(wen)本(ben)之日起十五日內未提出異議的,集(ji)體(ti)合同即行(xing)生效(xiao)。  

依法訂立(li)的集體(ti)合(he)同對用(yong)人單位和(he)勞(lao)動者具有(you)約束力(li)。行業性、區(qu)域性集體(ti)合(he)同對當地本行業、本區(qu)域的用(yong)人單位和(he)勞(lao)動者具有(you)約束力(li)。  

第五十五條 集體合同中勞(lao)動(dong)(dong)報(bao)酬和勞(lao)動(dong)(dong)條件(jian)(jian)等標準(zhun)不得(de)(de)低(di)于(yu)當(dang)地人(ren)民政(zheng)府規定(ding)的(de)(de)最低(di)標準(zhun);用人(ren)單位(wei)與勞(lao)動(dong)(dong)者訂立(li)的(de)(de)勞(lao)動(dong)(dong)合同中勞(lao)動(dong)(dong)報(bao)酬和勞(lao)動(dong)(dong)條件(jian)(jian)等標準(zhun)不得(de)(de)低(di)于(yu)集體合同規定(ding)的(de)(de)標準(zhun)。  

第(di)五(wu)十六條 用人(ren)(ren)單位(wei)違(wei)反(fan)集(ji)體合同,侵(qin)犯職(zhi)工勞動權益的,工會可以依(yi)法(fa)(fa)要求用人(ren)(ren)單位(wei)承擔責任;因履行集(ji)體合同發生爭議,經(jing)協商解決不成的,工會可以依(yi)法(fa)(fa)申請仲裁、提起訴(su)訟。

第二(er)節 勞務派遣  

第五(wu)十七條 經營勞務派遣業(ye)務應當具(ju)備下列條件:   

“(一)注(zhu)冊資(zi)本不得少于人民幣二(er)百萬(wan)元;  

“(二(er))有(you)與開展(zhan)業(ye)務相適應的固(gu)定的經營場所和設(she)施; 

“(三)有(you)符合法律(lv)、行(xing)政法規規定的勞務派遣管理制度;  

“(四)法(fa)律、行政法(fa)規規定的其他(ta)條件。 

“經營(ying)勞務(wu)(wu)派(pai)遣(qian)業(ye)務(wu)(wu),應當向勞動(dong)行(xing)政部門依(yi)法申請行(xing)政許可(ke)(ke);經許可(ke)(ke)的,依(yi)法辦理(li)相應的公司(si)登記(ji)。未經許可(ke)(ke),任何(he)單位和(he)個人不(bu)得經營(ying)勞務(wu)(wu)派(pai)遣(qian)業(ye)務(wu)(wu)。”  

第五十(shi)八條(tiao)(tiao) 勞(lao)務派(pai)遣單(dan)位(wei)是本法所稱用(yong)人單(dan)位(wei),應(ying)當履行用(yong)人單(dan)位(wei)對勞(lao)動(dong)(dong)者的義(yi)務。勞(lao)務派(pai)遣單(dan)位(wei)與被派(pai)遣勞(lao)動(dong)(dong)者訂立(li)的勞(lao)動(dong)(dong)合同,除應(ying)當載明(ming)本法第十(shi)七(qi)條(tiao)(tiao)規定的事項外(wai),還應(ying)當載明(ming)被派(pai)遣勞(lao)動(dong)(dong)者的用(yong)工單(dan)位(wei)以及派(pai)遣期限、工作(zuo)崗位(wei)等(deng)情況(kuang)。  

勞(lao)(lao)務派遣單(dan)位應當(dang)與被(bei)派遣勞(lao)(lao)動(dong)者(zhe)訂立二年以上的固定(ding)期限勞(lao)(lao)動(dong)合同(tong),按(an)(an)月支付(fu)勞(lao)(lao)動(dong)報(bao)酬(chou)(chou);被(bei)派遣勞(lao)(lao)動(dong)者(zhe)在(zai)無工作(zuo)期間,勞(lao)(lao)務派遣單(dan)位應當(dang)按(an)(an)照所在(zai)地人民(min)政府(fu)規定(ding)的最低(di)工資標(biao)準,向其按(an)(an)月支付(fu)報(bao)酬(chou)(chou)。  

第五(wu)十九(jiu)條 勞(lao)(lao)務派(pai)(pai)遣(qian)(qian)(qian)(qian)單(dan)(dan)位派(pai)(pai)遣(qian)(qian)(qian)(qian)勞(lao)(lao)動者應當與接受以(yi)(yi)勞(lao)(lao)務派(pai)(pai)遣(qian)(qian)(qian)(qian)形(xing)式(shi)用工的(de)(de)單(dan)(dan)位(以(yi)(yi)下稱(cheng)用工單(dan)(dan)位)訂(ding)立勞(lao)(lao)務派(pai)(pai)遣(qian)(qian)(qian)(qian)協(xie)議(yi)。勞(lao)(lao)務派(pai)(pai)遣(qian)(qian)(qian)(qian)協(xie)議(yi)應當約定(ding)派(pai)(pai)遣(qian)(qian)(qian)(qian)崗位和人員數量、派(pai)(pai)遣(qian)(qian)(qian)(qian)期限、勞(lao)(lao)動報酬和社會保(bao)險(xian)費的(de)(de)數額與支付(fu)方(fang)式(shi)以(yi)(yi)及違反協(xie)議(yi)的(de)(de)責(ze)任。  

用(yong)工單位應(ying)當(dang)根據(ju)工作崗位的實際需要(yao)與勞(lao)務派遣單位確定派遣期限,不得將連續(xu)用(yong)工期限分(fen)割訂立數(shu)個短期勞(lao)務派遣協(xie)議。  

第(di)六十條(tiao) 勞(lao)務(wu)派(pai)遣(qian)單位應(ying)當將勞(lao)務(wu)派(pai)遣(qian)協議的內容告(gao)知被派(pai)遣(qian)勞(lao)動者(zhe)。  

勞務(wu)派(pai)遣單(dan)位(wei)不得克扣用(yong)工單(dan)位(wei)按照勞務(wu)派(pai)遣協(xie)議支付給被派(pai)遣勞動者的勞動報酬。  

勞務派遣單位和用工單位不(bu)得向(xiang)被派遣勞動者收取費用。  

第六十一(yi)條 勞(lao)(lao)務(wu)派遣單位跨地(di)區派遣勞(lao)(lao)動(dong)者(zhe)的(de),被派遣勞(lao)(lao)動(dong)者(zhe)享(xiang)有的(de)勞(lao)(lao)動(dong)報酬和勞(lao)(lao)動(dong)條件,按照用工單位所(suo)在地(di)的(de)標準執行(xing)。  

第六(liu)十二條 用工單位(wei)應當履行下列(lie)義務:  

(一)執行國家勞動標準,提供相應(ying)的勞動條(tiao)件和勞動保護;  

(二)告知被(bei)派遣勞動(dong)者的工作要求和勞動(dong)報酬(chou)  

(三(san))支(zhi)付加班費、績效(xiao)獎金,提供與(yu)工作崗位相關的(de)福利待遇;  

(四)對在崗(gang)被派遣(qian)勞動者進行工(gong)作崗(gang)位所必需的培(pei)訓(xun)  

(五)連續用工的(de),實行正常的(de)工資(zi)調整機制。  用工單(dan)位(wei)不得將被派遣(qian)勞動者(zhe)再派遣(qian)到其他(ta)用人單(dan)位(wei)。  

第六十三條 被(bei)派(pai)(pai)遣勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)享有與用(yong)工(gong)(gong)(gong)單(dan)(dan)位(wei)(wei)(wei)(wei)(wei)被(bei)派(pai)(pai)遣勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)享有與用(yong)工(gong)(gong)(gong)單(dan)(dan)位(wei)(wei)(wei)(wei)(wei)的(de)(de)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)同(tong)(tong)工(gong)(gong)(gong)同(tong)(tong)酬(chou)的(de)(de)權(quan)利。用(yong)工(gong)(gong)(gong)單(dan)(dan)位(wei)(wei)(wei)(wei)(wei)應當按照同(tong)(tong)工(gong)(gong)(gong)同(tong)(tong)酬(chou)原則,對被(bei)派(pai)(pai)遣勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)與本(ben)單(dan)(dan)位(wei)(wei)(wei)(wei)(wei)同(tong)(tong)類崗位(wei)(wei)(wei)(wei)(wei)的(de)(de)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)實行(xing)相(xiang)同(tong)(tong)的(de)(de)勞(lao)(lao)動(dong)(dong)(dong)報酬(chou)分配辦法(fa)。用(yong)工(gong)(gong)(gong)單(dan)(dan)位(wei)(wei)(wei)(wei)(wei)無同(tong)(tong)類崗位(wei)(wei)(wei)(wei)(wei)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)的(de)(de),參照用(yong)工(gong)(gong)(gong)單(dan)(dan)位(wei)(wei)(wei)(wei)(wei)所在地(di)相(xiang)同(tong)(tong)或者(zhe)(zhe)(zhe)(zhe)相(xiang)近崗位(wei)(wei)(wei)(wei)(wei)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)的(de)(de)勞(lao)(lao)動(dong)(dong)(dong)報酬(chou)確定(ding)。  

“勞(lao)務(wu)派(pai)遣單位與(yu)被(bei)(bei)派(pai)遣勞(lao)動(dong)者(zhe)訂立(li)的勞(lao)動(dong)合同和(he)與(yu)用(yong)工單位訂立(li)的勞(lao)務(wu)派(pai)遣協議,載明或者(zhe)約定(ding)的向被(bei)(bei)派(pai)遣勞(lao)動(dong)者(zhe)支(zhi)付的勞(lao)動(dong)報(bao)酬應當符合前款規定(ding)。”。  

第六(liu)十四(si)條 被派遣(qian)勞動者(zhe)有權在(zai)勞務派遣(qian)單位或者(zhe)用(yong)工(gong)單位依(yi)法(fa)參加或者(zhe)組織(zhi)工(gong)會(hui),維護自身(shen)的合法(fa)權益。  

第六十五條 被派遣(qian)勞(lao)動(dong)者可(ke)以依照本法(fa)第三十六條、第三十八條的規定與(yu)勞(lao)務派遣(qian)單位解除(chu)勞(lao)動(dong)合同(tong)。  

被派(pai)遣(qian)勞(lao)(lao)動(dong)者(zhe)(zhe)有本法第(di)三十九(jiu)條(tiao)和(he)第(di)四十條(tiao)第(di)一項(xiang)(xiang)、第(di)二項(xiang)(xiang)規定(ding)情(qing)形的,用(yong)工單(dan)位(wei)可以(yi)將勞(lao)(lao)動(dong)者(zhe)(zhe)退(tui)回(hui)勞(lao)(lao)務派(pai)遣(qian)單(dan)位(wei),勞(lao)(lao)務派(pai)遣(qian)單(dan)位(wei)依照本法有關規定(ding),可以(yi)與(yu)勞(lao)(lao)動(dong)者(zhe)(zhe)解除勞(lao)(lao)動(dong)合同(tong)。  

第六十六條 勞(lao)動合同(tong)用(yong)(yong)工(gong)是(shi)我(wo)國(guo)的企業基本用(yong)(yong)工(gong)形式。勞(lao)務派遣用(yong)(yong)工(gong)是(shi)補充形式,只能在(zai)臨(lin)時性、輔助性或者替(ti)代性的工(gong)作(zuo)崗位上實施。  

“前款規定的(de)臨時(shi)性(xing)(xing)工(gong)作(zuo)崗(gang)位(wei)是(shi)指(zhi)存續時(shi)間不(bu)超(chao)過六個月的(de)崗(gang)位(wei);輔助性(xing)(xing)工(gong)作(zuo)崗(gang)位(wei)是(shi)指(zhi)為主營業務崗(gang)位(wei)提供服(fu)務的(de)非主營業務崗(gang)位(wei);替代性(xing)(xing)工(gong)作(zuo)崗(gang)位(wei)是(shi)指(zhi)用工(gong)單位(wei)的(de)勞(lao)動(dong)者因脫產學習(xi)、休假等原因無(wu)法工(gong)作(zuo)的(de)一(yi)定期間內,可以由其他勞(lao)動(dong)者替代工(gong)作(zuo)的(de)崗(gang)位(wei)。  

“用工(gong)(gong)單位應當(dang)嚴(yan)格控制勞(lao)務派遣(qian)用工(gong)(gong)數量,不得超過其(qi)用工(gong)(gong)總量的一定比(bi)例(li)(li),具體比(bi)例(li)(li)由(you)國務院(yuan)勞(lao)動行政部門規定。”。  

第(di)六十(shi)七(qi)條(tiao) 用人(ren)單位(wei)不得設(she)立勞(lao)務派遣單位(wei)向本單位(wei)或者(zhe)(zhe)所屬單位(wei)派遣勞(lao)動者(zhe)(zhe)。第(di)三節 非全(quan)日制用工(gong)  

第六十八條 非全(quan)日(ri)制用工,是指(zhi)以(yi)小時(shi)計酬為主,勞動者在同一(yi)用人單位一(yi)般(ban)平(ping)均每日(ri)工作時(shi)間不(bu)超過四(si)小時(shi),每周(zhou)工作時(shi)間累計不(bu)超過二十四(si)小時(shi)的用工形式。  

第六十(shi)九條 非全日制(zhi)用工雙(shuang)方(fang)當事人(ren)可以(yi)訂立口頭協議。  

從事非全日制用(yong)工的勞(lao)動(dong)者可以(yi)與一個(ge)或者一個(ge)以(yi)上用(yong)人單位訂立(li)勞(lao)動(dong)合同(tong);但是,后訂立(li)的勞(lao)動(dong)合同(tong)不(bu)得影響先訂立(li)的勞(lao)動(dong)合同(tong)的履(lv)行。  

第七十條 非全日制用工雙方當事人不得約定試用期。  

第七十一條 非全日制用(yong)(yong)工(gong)雙(shuang)方(fang)當事(shi)人任(ren)何(he)一方(fang)都(dou)可以隨時(shi)通知對方(fang)終止用(yong)(yong)工(gong)。終止用(yong)(yong)工(gong),用(yong)(yong)人單位不向勞(lao)動者支付(fu)經濟補償(chang)。  

第七十二條 非全(quan)日制用工(gong)小時(shi)計酬(chou)標準不(bu)得低(di)于用人單位所(suo)在地人民政府規定的最(zui)低(di)小時(shi)工(gong)資標準。  

非全日制用(yong)工勞動報酬結算支付周(zhou)期最長不得超(chao)過(guo)十五日。  

第六章 監督(du)檢查  

第七十三條 國務院勞動(dong)行(xing)政部門負責全(quan)國勞動(dong)合同(tong)制度實施的監督管理(li)。  

縣級(ji)以上地方人民(min)政(zheng)(zheng)府勞動行政(zheng)(zheng)部門負責本行政(zheng)(zheng)區域內勞動合同制(zhi)度實施的監督管理。  

縣級(ji)以(yi)上各級(ji)人民政(zheng)府勞(lao)動行政(zheng)部(bu)門在勞(lao)動合同制度實施的監督管(guan)理工作中,應當聽取(qu)工會、企業方面代表以(yi)及有關行業主管(guan)部(bu)門的意見。  

第七十四條 縣級以上地方人(ren)民(min)政府勞(lao)動行政部門依法(fa)對下列實施勞(lao)動合(he)同制度的情(qing)況進行監督檢查:  

(一)用(yong)人單位制定直接(jie)涉及勞動(dong)者切身利益的(de)規章制度(du)及其執行的(de)情況  

(二)用人單位與勞動(dong)者訂立和解除勞動(dong)合同的情(qing)況;  

(三)勞務(wu)派遣單位和用(yong)工(gong)單位遵守勞務(wu)派遣有關規(gui)定(ding)的情況(kuang)  

(四)用人單位遵守國(guo)家關于勞動者工作(zuo)時(shi)間(jian)和休息休假(jia)規定的情況;  

(五)用人單位支付勞(lao)動合同(tong)約定的(de)勞(lao)動報酬和(he)執(zhi)行最低工資標準的(de)情況  

(六)用人(ren)單位參(can)加各項社會(hui)保險和繳納社會(hui)保險費的情況;  

(七)法律、法規規定的其他勞動監察事項。  

第(di)七十五條 縣(xian)級以(yi)上地(di)方人(ren)民政(zheng)府勞(lao)(lao)動(dong)(dong)行政(zheng)部(bu)門實(shi)施(shi)監(jian)督(du)檢查(cha)(cha)(cha)時,有(you)(you)權(quan)(quan)查(cha)(cha)(cha)閱與(yu)勞(lao)(lao)動(dong)(dong)合(he)同、集體合(he)同有(you)(you)關的材料,有(you)(you)權(quan)(quan)對勞(lao)(lao)動(dong)(dong)場所(suo)進行實(shi)地(di)檢查(cha)(cha)(cha),用人(ren)單(dan)位和勞(lao)(lao)動(dong)(dong)者都應當如實(shi)提供有(you)(you)關情況和材料。  勞(lao)(lao)動(dong)(dong)行政(zheng)部(bu)門的工(gong)作(zuo)人(ren)員(yuan)進行監(jian)督(du)檢查(cha)(cha)(cha),應當出示(shi)證件,依法行使職權(quan)(quan),文明執(zhi)法。  

第七十(shi)六條 縣級以上人民政府建設、衛生、安全生產監(jian)督管(guan)理等有關主(zhu)管(guan)部門在各自職責范(fan)圍內,對用(yong)人單(dan)位執行勞動合同(tong)制度的情(qing)況(kuang)進行監(jian)督管(guan)理。  

第七十七條 勞動者合法權益受(shou)到侵(qin)害的(de),有(you)權要求(qiu)有(you)關部門依法處理,或者依法申(shen)請仲裁、提起(qi)訴訟。  

第七十八(ba)條(tiao) 工(gong)(gong)(gong)會(hui)依法(fa)維護(hu)勞(lao)(lao)動者(zhe)(zhe)的合(he)法(fa)權益,對(dui)用人(ren)單位履行(xing)(xing)勞(lao)(lao)動合(he)同(tong)、集(ji)體合(he)同(tong)的情況進行(xing)(xing)監督。用人(ren)單位違反勞(lao)(lao)動法(fa)律、法(fa)規和勞(lao)(lao)動合(he)同(tong)、集(ji)體合(he)同(tong)的,工(gong)(gong)(gong)會(hui)有(you)權提出(chu)意見或者(zhe)(zhe)要求糾(jiu)正(zheng);勞(lao)(lao)動者(zhe)(zhe)申請仲裁、提起訴訟的,工(gong)(gong)(gong)會(hui)依法(fa)給(gei)予支持和幫助。  

第七十九條(tiao) 任何組織或者個人對(dui)違反本(ben)法的行為都(dou)有權(quan)舉報,縣級以(yi)上人民政(zheng)府勞動(dong)行政(zheng)部門應當及時核實、處理,并對(dui)舉報有功人員給予(yu)獎勵(li)。  

第七章 法律(lv)責(ze)任  

第八十條(tiao) 用人單位直接(jie)涉(she)及勞(lao)動(dong)者切身利益的規章制度違(wei)反法律、法規規定的,由勞(lao)動(dong)行政部(bu)門責令(ling)改正,給予警告;給勞(lao)動(dong)者造成損(sun)害的,應當(dang)承擔賠(pei)償責任。  

第八(ba)十一條(tiao) 用人單位提供的(de)勞動合同文(wen)本未載(zai)明(ming)本法規定的(de)勞動合同必備條(tiao)款或者用人單位未將勞動合同文(wen)本交付(fu)勞動者的(de),由勞動行政部門責(ze)令改正;給勞動者造(zao)成損害的(de),應當承擔賠(pei)償責(ze)任。  

第(di)八(ba)十二(er)條 用(yong)人單位自用(yong)工之日起超過一個(ge)月不(bu)滿一年未(wei)與勞動(dong)(dong)(dong)者訂立書面勞動(dong)(dong)(dong)合同(tong)的,應當向(xiang)勞動(dong)(dong)(dong)者每月支付二(er)倍的工資(zi)。  

用(yong)人單位違(wei)反(fan)本法規定不與勞(lao)動者訂立(li)無固定期(qi)限勞(lao)動合同的,自應當訂立(li)無固定期(qi)限勞(lao)動合同之日起(qi)向勞(lao)動者每月支付二倍的工資(zi)。  

第八十三條 用人(ren)單位(wei)違(wei)反本法規定(ding)(ding)與勞(lao)(lao)動者約(yue)定(ding)(ding)試(shi)用期(qi)(qi)的,由勞(lao)(lao)動行政部門(men)責(ze)令(ling)改正;違(wei)法約(yue)定(ding)(ding)的試(shi)用期(qi)(qi)已經履行的,由用人(ren)單位(wei)以勞(lao)(lao)動者試(shi)用期(qi)(qi)滿月工資(zi)為標(biao)準(zhun),按已經履行的超過(guo)法定(ding)(ding)試(shi)用期(qi)(qi)的期(qi)(qi)間向勞(lao)(lao)動者支付賠償金。  

第八(ba)十四條(tiao) 用人單(dan)位違(wei)反本(ben)法規定,扣押勞(lao)動(dong)者(zhe)居(ju)民(min)身份證(zheng)等證(zheng)件的,由勞(lao)動(dong)行政部(bu)門責令限期(qi)退(tui)還勞(lao)動(dong)者(zhe)本(ben)人,并(bing)依照(zhao)有關法律(lv)規定給予處罰。  

用人單位違反(fan)本法規定,以擔保或者其他(ta)名義向勞動(dong)(dong)(dong)者收(shou)取(qu)財物的,由勞動(dong)(dong)(dong)行政部(bu)門責令限(xian)期退還勞動(dong)(dong)(dong)者本人,并(bing)以每人五百元以上(shang)二千元以下(xia)的標準(zhun)處(chu)以罰款;給勞動(dong)(dong)(dong)者造(zao)成損害的,應當承擔賠償責任。  

勞動者(zhe)依法(fa)解除或者(zhe)終止勞動合同(tong),用(yong)人(ren)單位(wei)扣押勞動者(zhe)檔(dang)案或者(zhe)其他物品的,依照前款規(gui)定處罰。  

第八十五(wu)條 用(yong)人單(dan)位有下(xia)列情形之一的(de),由勞(lao)(lao)動(dong)行政(zheng)部門(men)責令限期(qi)支付(fu)勞(lao)(lao)動(dong)報(bao)酬、加班費或(huo)者(zhe)經濟補(bu)償(chang);勞(lao)(lao)動(dong)報(bao)酬低于當地最低工(gong)資標準(zhun)的(de),應當支付(fu)其差額部分;逾期(qi)不支付(fu)的(de),責令用(yong)人單(dan)位按應付(fu)金(jin)額百分之五(wu)十以上百分之一百以下(xia)的(de)標準(zhun)向勞(lao)(lao)動(dong)者(zhe)加付(fu)賠償(chang)金(jin):  

(一(yi))未按照勞(lao)動(dong)合同的約(yue)定或者國家(jia)規定及時足額支(zhi)付勞(lao)動(dong)者勞(lao)動(dong)報(bao)酬的;  

(二(er))低(di)(di)于當地最低(di)(di)工(gong)資標(biao)準支付(fu)勞(lao)動(dong)者工(gong)資的(de)  

三)安排加班不(bu)支付加班費的(de);  

(四)解(jie)除或(huo)者(zhe)終(zhong)止勞動(dong)(dong)合同,未依照(zhao)本法規(gui)定向勞動(dong)(dong)者(zhe)支付經濟補償的。  

第(di)(di)八十(shi)六條(tiao)(tiao) 勞(lao)動(dong)合同(tong)依照本法第(di)(di)二十(shi)六條(tiao)(tiao)規定被確認無效,給對方造成損害的(de),有過(guo)錯的(de)一(yi)方應當承擔(dan)賠償責任。  

第(di)八十七條 用人單位違反本(ben)(ben)法(fa)規定解除或者終止勞(lao)(lao)動合同的,應當依照本(ben)(ben)法(fa)第(di)四十七條規定的經濟補償(chang)標準(zhun)的二倍向勞(lao)(lao)動者支付賠償(chang)金。  

第(di)八十八條 用人單位有下列情形(xing)之一的(de),依法給予(yu)行政處罰;構成(cheng)犯罪的(de),依法追究刑事(shi)責任;給勞動者造(zao)成(cheng)損害的(de),應(ying)當承擔賠(pei)償責任:  

(一)以暴力、威脅或者(zhe)非法限(xian)制(zhi)人身自由的手段強(qiang)迫勞(lao)動的  

(二)違(wei)章指(zhi)揮或者(zhe)強令冒(mao)險(xian)作業危(wei)及勞動者(zhe)人身安全的;  

(三)侮(wu)辱、體(ti)罰、毆打、非法搜查或者拘禁勞動者的  

(四)勞動(dong)條件惡劣(lie)、環境污染嚴重,給(gei)勞動(dong)者身心健康(kang)造成嚴重損害的(de)。  

第八十九條(tiao) 用人單(dan)位違反本法規定未向(xiang)勞(lao)(lao)動(dong)者出具解除或(huo)者終止勞(lao)(lao)動(dong)合同的(de)(de)書面證明,由勞(lao)(lao)動(dong)行政部門責(ze)令(ling)改正;給勞(lao)(lao)動(dong)者造(zao)成損害的(de)(de),應(ying)當承擔賠償責(ze)任。  

第九十條(tiao) 勞(lao)動(dong)者(zhe)(zhe)違反本法規定(ding)解除勞(lao)動(dong)合(he)同,或者(zhe)(zhe)違反勞(lao)動(dong)合(he)同中約定(ding)的保密(mi)義務(wu)或者(zhe)(zhe)競業限制,給用人(ren)單位(wei)造(zao)成損失的,應當承擔賠(pei)償責(ze)任。  

第九(jiu)十一條 用人單位招用與其他(ta)用人單位尚未解除或者終止勞動(dong)合(he)同的勞動(dong)者,給其他(ta)用人單位造成損失的,應當(dang)承(cheng)擔連帶賠償責任(ren)。  

第九十(shi)二條 違(wei)(wei)反本法(fa)規定,未(wei)經許可(ke),擅(shan)自(zi)經營勞(lao)務(wu)派(pai)遣(qian)業務(wu)的,由勞(lao)動行(xing)政部門責令停止違(wei)(wei)法(fa)行(xing)為(wei),沒(mei)收違(wei)(wei)法(fa)所得,并處違(wei)(wei)法(fa)所得一倍以(yi)上(shang)五倍以(yi)下的罰(fa)(fa)款;沒(mei)有違(wei)(wei)法(fa)所得的,可(ke)以(yi)處五萬元以(yi)下的罰(fa)(fa)款。  

“勞(lao)(lao)務(wu)(wu)派(pai)遣(qian)單(dan)(dan)位(wei)、用(yong)(yong)工(gong)單(dan)(dan)位(wei)違反本法(fa)有關勞(lao)(lao)務(wu)(wu)派(pai)遣(qian)規(gui)定(ding)的(de),由勞(lao)(lao)動行政部(bu)門(men)責(ze)令限(xian)期(qi)改正;逾期(qi)不改正的(de),以(yi)(yi)每人五千(qian)元以(yi)(yi)上一(yi)萬元以(yi)(yi)下的(de)標準處以(yi)(yi)罰款,對勞(lao)(lao)務(wu)(wu)派(pai)遣(qian)單(dan)(dan)位(wei),吊銷其勞(lao)(lao)務(wu)(wu)派(pai)遣(qian)業務(wu)(wu)經營許(xu)可證。用(yong)(yong)工(gong)單(dan)(dan)位(wei)給被派(pai)遣(qian)勞(lao)(lao)動者造成損害的(de),勞(lao)(lao)務(wu)(wu)派(pai)遣(qian)單(dan)(dan)位(wei)與用(yong)(yong)工(gong)單(dan)(dan)位(wei)承擔連帶(dai)賠(pei)償(chang)責(ze)任(ren)。”[4]。  

第九十三(san)條 對不具備(bei)合(he)法(fa)(fa)經營資格的用人單位(wei)的違法(fa)(fa)犯罪行為,依(yi)(yi)法(fa)(fa)追究法(fa)(fa)律責任;勞(lao)動(dong)者(zhe)已經付出(chu)(chu)勞(lao)動(dong)的,該單位(wei)或者(zhe)其出(chu)(chu)資人應當依(yi)(yi)照本法(fa)(fa)有(you)關規定向勞(lao)動(dong)者(zhe)支(zhi)付勞(lao)動(dong)報(bao)酬、經濟(ji)補償、賠(pei)償金(jin);給勞(lao)動(dong)者(zhe)造成(cheng)損害的,應當承擔賠(pei)償責任。  

第九十四條 個人承包經(jing)營違反本法(fa)規定(ding)招用勞動者(zhe),給勞動者(zhe)造(zao)成損害的(de),發(fa)包的(de)組(zu)織與個人承包經(jing)營者(zhe)承擔連帶(dai)賠償(chang)責任(ren)。  

第九十五(wu)條 勞(lao)動行政部(bu)門(men)和其(qi)他有關主管部(bu)門(men)及其(qi)工作人(ren)(ren)員玩忽職(zhi)(zhi)守、不履行法(fa)定職(zhi)(zhi)責(ze),或(huo)者違法(fa)行使職(zhi)(zhi)權,給勞(lao)動者或(huo)者用人(ren)(ren)單位造成(cheng)損害(hai)的,應(ying)當承(cheng)擔賠償責(ze)任;對直接(jie)負責(ze)的主管人(ren)(ren)員和其(qi)他直接(jie)責(ze)任人(ren)(ren)員,依(yi)法(fa)給予行政處分;構(gou)成(cheng)犯(fan)罪的,依(yi)法(fa)追究刑(xing)事(shi)責(ze)任。  

第八章 附則  

第九十六條 事業單位與實行聘(pin)用制的(de)工作(zuo)人員訂立、履行、變更、解除(chu)或(huo)者(zhe)終止勞(lao)動合(he)同,法律(lv)、行政法規(gui)或(huo)者(zhe)國務院(yuan)另有規(gui)定(ding)(ding)(ding)的(de),依(yi)照(zhao)(zhao)其規(gui)定(ding)(ding)(ding);未作(zuo)規(gui)定(ding)(ding)(ding)的(de),依(yi)照(zhao)(zhao)本法有關規(gui)定(ding)(ding)(ding)執行。  

第(di)九十七條 本(ben)法(fa)(fa)(fa)施(shi)行前已依(yi)法(fa)(fa)(fa)訂(ding)立且(qie)在(zai)本(ben)法(fa)(fa)(fa)施(shi)行之日存(cun)續的勞動(dong)(dong)合同,繼(ji)續履行;本(ben)法(fa)(fa)(fa)第(di)十四條第(di)二(er)款第(di)三項規(gui)定連(lian)續訂(ding)立固定期限勞動(dong)(dong)合同的次數,自本(ben)法(fa)(fa)(fa)施(shi)行后續訂(ding)固定期限勞動(dong)(dong)合同時開始計(ji)算。  

本法(fa)施行(xing)前已建立勞動關系,尚未訂立書面勞動合同(tong)的,應當自本法(fa)施行(xing)之日起一(yi)個月內訂立。  

本(ben)法(fa)(fa)施(shi)(shi)行(xing)之日(ri)存續的勞動(dong)合(he)同在本(ben)法(fa)(fa)施(shi)(shi)行(xing)后(hou)解除或者終(zhong)止(zhi),依照本(ben)法(fa)(fa)第四十六(liu)條規(gui)定應當(dang)支付(fu)經(jing)濟補償(chang)的,經(jing)濟補償(chang)年限自本(ben)法(fa)(fa)施(shi)(shi)行(xing)之日(ri)起計算;本(ben)法(fa)(fa)施(shi)(shi)行(xing)前(qian)按(an)照當(dang)時有關規(gui)定,用(yong)人(ren)單位應當(dang)向(xiang)勞動(dong)者支付(fu)經(jing)濟補償(chang)的,按(an)照當(dang)時有關規(gui)定執行(xing)。第九十八(ba)條 本(ben)法(fa)(fa)自2008年1月(yue)1日(ri)起施(shi)(shi)行(xing)。-說明:經(jing)過(guo)全國(guo)(guo)人(ren)民(min)代表大(da)會(hui)常務委員會(hui)于2012年12月(yue)28日(ri)通過(guo)第一(yi)次修(xiu)正后(hou)的《中華人(ren)民(min)共和(he)國(guo)(guo)勞動(dong)合(he)同法(fa)(fa)<2013年新修(xiu)正版(ban)>》自2013年7月(yue)1日(ri)起施(shi)(shi)行(xing)。
